【Sub-title】

To have deep knowledge on regulatory framework and practical approaches of PPP in Japan

【Course Purpose and Description】

There are various regulatory framework which enables Public Private Partnerships (PPP) in Japan such as the Private Finance Initiative (PFI), market testing, designated administrator system, city regeneration,etc. Structural Strategoc Special Zones shall also fall under such category. As a legal framework which may be linked with PPP for local governments' fiscal and administrative reform, there exist Law on Assurance of Sound Financial Status of Local Governments, Laws and decrees relating Accounting Reform & Reform of Government Assets and Liabilities and various legal framework related to Public Corporation Reform, and Third Sector Reform.

The purpose of this course is for students to precisely understand the details of these various Legal framework and methods and to train their abilities in their practical use. Lectures shall be conducted by inviting each time guest lectuerers who are responsible government officials of the relevant Ministries (including experts in Local Governments), followed by discussions and debates.

To foster the basic ability to find optimum solutions in specific cases by utilizing various legal framework and implemental measures involved in the practice of PPP

【Schedule】

Total coordination and responsibility of the course shall be conducted by the Instructor H.Machida, while each lecture shall be conducted by inviting Government Officials in charge of respective legal framework or policy so that the students may be able to grasp and deepen their understanding on specific issue and this shall be fortified by question and answer sessions and subsequent debates with H.Machida as a facilitator/coordinator. Whole lecture shall be conducted throughInternet.
Fllowing illustrates a rough schedule and content of this course, which may be subject to change depending on the latest trend of policies and availability of guest lecturers. Equally, the order of each topic may change due to the convenience of guest lecturers.

Lecture 3;PPP/PFI Current policy, Action Plan, Concession
Lecture 4:New PPP/PFI Institutional Framwork:PFS
Lecture 5:PPP/PFI for MLIT (Ministry of Land, Infrastructure, Transport and Tourism)
Lecture 6:City regeneration policy/Compact City(MLIT)
Lecture 7:City Sewage system PPP/PFI (MLIT)
Lecture 8:Water Supply sytem PPP/PFI(Ministry of Health & Labor)
Lecture 9:Local Fiscal policy,Public Accounting、Public Facility Management Plan(Ministry of General Affairs)
Lecture 10:Local Public Enterprise, Third sector entity (Ministry of General Affairs)
Lecture 11; Designated Public Facility Administrator, PPP/PFI by Ministry of General Affairs
Lecture 12,13,14 :Case studies on leading local governments’efforts for PPP by inviding relevant local governments officials as guest lecturer.
Lecture 15: Summary, Issues and prospects of PPP in Japan, and presentation of students' report papers.

【Instructional Methods】

The Lectures shall be conducted by simultaneous bilateral remort method by using internet.
For each lecture, PowerPoint presentation materials shallbe used and related materials are distributed through Manaba a day before the related lecture. Students can deepen their understanding and enhance their practical abilities by learning how the legal framework and policies are being practised and by participating in question and answer sessions and discussions. Questions and Answers shall also be conducted via internet.

【Self-study before/after classes】

Prior studies:
Prior advanced studies on the relevant legal framework are recommended with positive participation to raise questions and debate.
Post studies:
Try to follow up the results of lecture and learning which may have some linkage to your proper studies and/or actual businesses

【Methods of Evaluation and Grading Criteria】

Grading: attendance(50%) and final report papers (50%). (Theme of report to be requested : “Point out issues in Japan’s PPP legal framework and practices and proposal in a practival way.Volume of the report: Approximately 2 pages on A4 paper)

Through these lectures, students are required to take up issues and problems they have captured from their own perspective and to think about what they can do to solve these problems and issues. Then, students are further required to make presentations during the last lecture.
Grating Criteria: S:100-90 A:90>=80 B:80>=70 C:70>=60 Under 60 means a faiiure.

【Pre-requisites】

None in particular

【Textbooks】

Textbooks will be provided by the guest lecturer of each lecture and will be distributed through Manaba a day before the relevant lecture. Since the volume of each text materials will be quite large, it is recommended to read through it beforehand to prepare for the class. It is highly recommended to prepare and participate into Q&A sessions to enhance level of understanding and vitalize debates with participants involved.

Reference materials will be recommended in lectures as required.

【Related Study Fields and Courses】

Similar lectures on PPP legat framework may exist in other courses and some of students may consider such to be redundant however, the main focus of this course will be direct lectures from policy maker of this Government which is rare experience and the contents do not overlap.
The instructor, H.Machida, has been engaged in PPP policy-making process of Japanese Government for more than 20years as director of PFI Promotion Office in Cabinet Office and director-general in MLIT,for instance.
Furthermore this class will provide golden opportunities to directly listen to explanations of relevant policies and legal framework from Government officials and to have discussions with them. Active participation by students are recommended.
